Sales conditions

The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302 and Article L.211-2 II of the French Tourism Code.

You will therefore benefit from all the rights granted by the European Union applicable to packages, as transposed into the Tourism Code. Europe Active will be entirely responsible for the proper execution of the package as a whole.

In addition, as required by law, the Europe Active company has protection to refund your payments and, if transport is included in the package, to ensure your repatriation in the event that it becomes insolvent.

Registration for one of our holidays or trips implies acceptance of our general terms and conditions. Your booking will only be taken into account once we have received your completed and signed booking form if you are booking by post, or your completed and validated booking form if you are booking via our website, subject to availability of the holiday at the time the booking is received. This booking must be accompanied by a deposit of 30% of the total cost of the holiday if the booking is made more than 30 days before departure or 100% of the total cost of the holiday if the booking is made less than 30 days before departure. The balance must be paid one month before the start of the holiday. For stays outside Europe, the balance must be paid 45 days before departure.

This booking must be accompanied by a deposit (excluding Tourist Trophy Tours and trips outside Europe):

  • a deposit of 30% of the total cost of the holiday if the booking is made more than 30 days before departure or 100% of the total cost of the holiday if the booking is made less than 30 days before departure.
  • The balance must be paid one month before the start of the holiday.

For Tourist Trophy Tours :

  • a deposit of 50% of the total cost of the holiday if booked more than 140 days before departure or 100% of the total cost of the holiday if booked less than 140 days before departure.
  • The balance must be paid 140 days before the start of the holiday.

For stays outside Europe:

  • a deposit of 30% of the total cost of the holiday if booked more than 45 days before departure or 100% of the total cost of the holiday if booked less than 45 days before departure.
  • The balance must be paid 45 days before the start of the holiday.

The deposit may exceed 30% of the total cost of the holiday if a service provider (rental company, accommodation provider, airline or other) asks the agency for a financial advance for the booking that exceeds the amount of this deposit.

Europe Active vehicule hire

This paragraph applies to a holiday including the hire of a Europe Active vehicle or to a dry hire (without a holiday). When you book a trip that includes the hire of a vehicle from the Europe Active fleet, you must pay a deposit which is included in the deposit (or in the balance if you pay in one go).

For bookings made more than one month before the rental start date, a deposit is required depending on the vehicle chosen. If the amount of the deposit exceeds the amount of the deposit, you must pay the deposit in full. Payment for rented vehicles must be made one month before departure in order to guarantee the rental of the vehicle(s). Cancellation charges in excess of the deposit apply in the event of cancellation one month before departure, in accordance with the scale defined in the following paragraph (excluding the rental of nine-seater vehicles or campers described on the corsica-camper.fr website).

Cancellation (stays and rentals)

In the event of cancellation on your part, Europe Active will retain the cancellation fee (excluding Tourist Trophy Tours and stays outside Europe):

  • more than 30 days before departure: €100 cancellation fee per person for stays. Deposits paid will be retained for rentals.
  • between 29 and 16 days: 50% of the total amount.
  • between 15 and 2 days: 90% of the total amount.
  • less than 2 days: 100% of the total amount.

Tourist Trophy Tours :

  • more than 140 days before departure: 50% of the cost of the stay.
  • less than 140 days: 100% of the cost of the stay.

Stays outside Europe :

  • more than 45 days before departure: 30% of the total amount.
  • less than 45 days: 100% of the total amount.

Don't forget to give us plenty of notice by expressly stating a "cancellation request" in writing so that we can validate your cancellation date.

The sums withheld may be reimbursed if you have taken out cancellation insurance. See the refund conditions on the document you have been given.

If you fail to keep your appointment, or if you are unable to produce the police or health documents required for travel (passport, visa, vaccination certificate), you will not be entitled to any refund.

Please note that for bookings for transport to your holiday destination, such as ferries, trains or planes, especially for low-cost airlines, it is important to note that we only act as an intermediary and that cancellation conditions must be discussed directly with these airlines and are not our responsibility; in conclusion, any costs relating to these means of transport will be billed to you in addition to the Europe Active cancellation charges. Only the special and general conditions of sale will be taken into account in the event of cancellation or any problem whatsoever.

With regard to the Tourist Trophy, as ferry bookings are not linked to accommodation bookings on the Isle of Man, the cost of accommodation in the event of cancellation of ferry crossings cannot be reimbursed by Europe Active under any circumstances. Europe Active will do its utmost to offer its customers a solution to reach the Isle of Man (or the continent in the opposite direction) but any additional costs generated by the situation will be charged to the end customer.

With regard to any rentals (vehicles, equipment, etc.) made by external service providers other than Europe Active, the cancellation conditions that apply are their own. These cancellation conditions will then be added to those described above for Europe Active. Europe Active acts only as an intermediary with these service providers on behalf of the end customer.

Similarly, in the case of the sale of a "tailor-made" holiday, additional cancellation charges may be invoiced to reflect the charges requested in the cancellation conditions of certain service providers.

If you find a replacement to make up for your cancellation, a change fee will apply (see paragraph below).

No right of withdrawal applies to the booking of a holiday.

Interruption

If a participant interrupts his or her stay, no reimbursement will be made. Please check the refund conditions offered by your insurance company.

Change of stay

If you wish to change your stay or date of stay more than 30 days before departure, a flat-rate charge of €100 will be deducted per person.

Less than 30 days before departure (45 days for stays outside Europe), any change to the stay will be considered as a cancellation and the cancellation charges shown above will apply.

For Tourist Trophy Tours holidays, if you wish to change your holiday or date of stay more than 140 days before departure, a flat-rate fee of €100 per person will be added. Less than 140 days before departure, any change to the holiday will be considered as a cancellation and the cancellation charges set out above will apply.

Any modification to the stay involving the services of service providers external to Europe Active (vehicle hire, air transport, sea transport, etc.) and requiring modification costs will be charged to the customer in addition to the costs retained by Europe Active and described above.

If the holiday is cancelled by us because the minimum number of participants has not been reached, due to conditions jeopardising the safety of the participants or for reasons of force majeure 21 days before departure, you will in most cases be offered at least one alternative package. If you are not happy with this alternative, you will receive a full refund.

Prices

The price of the holiday is as advertised on the website. The services included and not included during the stay are specified in the description of the stay. Supplements and discounts may be available on the same page.

Departure dates confirmed on the agency's websites

Insured departures are subject to final confirmation of current enrolment options. This information is updated regularly. It is provided on a provisional basis to facilitate your choice of booking and is not contractually binding, as slight delays may occur from time to time.

Litigation

Any contestation or dispute must be carried out in front of the commercial court of Bastia.

Responsibility

Europe Active cannot replace the several liabilities for each participant. Each participant must take responsibility for obtaining all of the documents necessary for the successful completion of the holiday (for example, identity papers, authorizations, visas, vaccines).

Each participant is responsible for his own luggage and must ensure his luggage is present before and after every transfer.

As a tour operator, Europe Active works with various people providing services and receiving benefits (hotel keepers, managers of accommodation, carriers, various other people receiving benefits) and must not be confused with these other providers who retain their appropriate responsibility.

Risks

Our holidays include for the most part activities in the open air and in nature and are activities presenting risks inherent to the practice of the activities themselves. Each participant assumes these risks in full knowledge of the facts and makes a commitment not to make Europe Active, the guides or the various providers involved, carry the responsibility of the accidents or the incidents which can arise in the normal frame of the activities. This clause also applies to any legal successor and to the members of the family of the participant.

Every participant has to conform to the rules of prudence and follow the advice given by the guide representing the agency, who cannot be considered as the person responsible for the accidents resulting from the carelessness of a member of the group.

Europe Active reserves the right, if particular circumstances questioning the safety of the group demand it, to modify the route or certain services of the program, directly or through the guide. The independent holidays are routes sold without a guide. The fixed price includes a description of the route and a map presenting the area. The independent holidays thus involve a suitable knowledge of map reading and orientation.

Every participant has to conform to the rules of prudence and follow the advice given by the topo-guide or route notes. Europe Active cannot be considered as the person responsible for the accidents resulting from the carelessness of a participant. Neither can Europe Active be considered as person in charge of a bad interpretation of the description or an error of reading the map of the user (in particular for meteorological reasons). The independent holiday supposes the acceptance of a risk, which can be due, in particular, to a modification of elements on the route. Consequently, every participant makes a commitment to accept this risk and not to make Europe Active, or the various providers, carry the responsibility of the accidents or the incidents which can arise. This clause also applies to any legal successor and to the members of the family of the participant in question.

Insurances

According to the regulations of our profession, we are insured in Professional Civil liability. However we would not substitute ourselves for the Personal Civil liability that every participant has to hold in person.

It is indispensable for a participant to possess an individual insurance for multi-risk and multi-activity holidays (expenses of cancellation, research - help, repatriation, medical expenses, theft of luggage, etc.) adapted well to the activities to be undertaken as part of the holiday.

The insurance assistance from which many participants benefit in a general contract is often minimal. This type of coverage is rarely adapted to the types of holidays that we propose.

The Europe Active group is the only company in Corsica to have the French equivalent of an ATOL bond. So, if our company closes down, disappointed customers will be guaranteed a refund for their holiday. In addition, the French equivalent of an ATOL bond offers additional financial protection: it covers every single type of holiday and not just flight inclusive holidays.

Rental from external companies

In case of rental (car, motorbike, or any other form of equipment) entered into with external companies,  it is the rental conditions of the external company that will apply for the duration of your holiday with Europe-Active.   The rental conditions of the external company supplement  and do not replace the  full conditions of sale described here. Europe-Active acts as an intermediary between the client and the external company only.

You benefit of a right of access to your information. The website Europe Active is officially the object of a declaration with the CNIL.
